Firm Sues Galveston City Council
March 2012

The Firm filed a lawsuit against the City of Galveston on behalf of the Indian Beach Property Owners after the City Council overturned a Planning Commission decision that a dog kennel on the West End of Galveston was not compatible with the neighborhood and is not in compliance with the Comprehensive Plan of the City of Galveston. An appeal of the Planning Commission’s decision asked the City Council to review whether the Planning Commission acted in an “arbitrary and capricious manner” when it denied approval of the plan.

The lawsuit asks that the City Council’s decision be overturned and that the City be enjoined from approving building permits for the business.

Attorneys representing Indian Beach Property Owners are Partners, Stephen G. Schulz and Andrew J. Mytelka, and Associate, Eric Kirkpatrick, all of the Galveston office.
