Greer, Herz & Adams, LLP recently secured a significant victory for Diamond Hydraulics before the Texas Supreme Court.
The case concerned a bent hydraulic cylinder, and originated in Williamson County. A month before trial, Diamond Hydraulics’ testifying expert changed jobs, left the State, and refused to testify. When GAC’s attorney would not agree to a substituted expert, Diamond Hydraulics’ request for leave to designate a substitute expert was denied, as were its motions for reconsideration and continuance. It was forced to trial without an expert.
In its March 31, 2026 Opinion, the Texas Supreme Court agreed with Diamond Hydraulics, holding that “[g]ood cause is a demanding standard, not an impossible one”, and that Diamond Hydraulics demonstrated good cause for the substitution. The Court reversed the lower courts’ judgments, and remanded the case for a new trial.
