Attorneys from GH&A’s Commercial Litigation team, Joseph Russo, Angie Olalde and Andrew Mytelka, represented the Galveston County District Attorney in a Section 1983 civil right class action challenging Galveston County bail recommendation and pretrial procedures. Among other things, the Plaintiff alleged that the District Attorney’s practice of recommending bail at initial appearance violated an arrestee’s Constitutional rights. GH&A navigated the District Attorney through class certification and preliminary injunction proceedings, and through two interlocutory appeals to the U.S. Court of Appeals for the Fifth Circuit, leading ultimately, to the Federal Magistrate Judge recommending dismissal of the lawsuit and denying Plaintiff’s request for a stay.
